Reproductive health technology allows married couples who experience infertility to have a child through assisted reproductive technology (ART), such as the in vitro fertilisation (IVF) process. The transfer of the extracted embryo to the woman’s womb is called surrogacy technology (gestational surrogacy). The legality of the practice of surrogacy is still questionable, both on a national and international level. This research discussed the legality of surrogacy in some religious countries, focusing on Indonesia. This research used normative juridical research methods or (...) literature review through a comparative religion-legal approach. This study indicated that most do not have a specific legal instrument regarding surrogacy practice. International law also does not have a standard legal instrument regarding the legality of surrogacy. Legality is determined by each religious country’s national laws and customs. For example, Indonesian law prohibits this practice implicitly under Law No. 36 of 2009 concerning health. The United Kingdom legalised surrogacy through the Surrogacy Agreement Act 1985, which was amended to the Human Fertilization and Embryology Act 2008, Greece through the Greek Legislation Law 3089/2002 and Law 3305/2005, and India through the 2019 Surrogacy Regulation Bill. Those countries have their limitations and characteristics that rule surrogacy. Surrogacy is indeed a technological advancement in the health sector. However, for countries that are influenced much by religion, technological advances sometimes conflict with the culture and the belief that has long been followed by most of the population. For Indonesia, the largest of Sunni Islam ruled surrogacy against the law. Next, Iran, as a Shia Islam country, ruled that surrogacy is a legal action.Contribution: The research provided information and knowledge regarding the different settings of surrogacy practice. The Indonesian Constitution guarantees the freedom of Indonesian citizens to worship according to their religion. In reality, however, the Indonesian government had issued regulations that restrict the building of worship places, which is one way of expressing religious freedom. These regulations, being trapped in the discourse of the politicisation of religion and the religionisation of politics, are contradictory to the aspirations of the founding fathers as expressed in the Indonesian Constitution. This article seeks to deal with this problem by conducting (...) a critical and reflective study on religion–state relations, particularly on the concept of sphere sovereignty proposed by Abraham Kuyper. This study employed the content analysis method. The study demonstrates that this concept, when applied to the Indonesian situation, would prove helpful in restoring normative leadership to Indonesian politics and would enable it to align itself with the values of the Indonesian Constitution. The study also recommends a number of practical strategies in protecting religious freedom and rights in Indonesia, especially with regard to the restrictions on building worship places.Contribution: The study of the concept of Kuyper’s Sphere Sovereignty can be helpful in restoring normative leadership to Indonesian politics and would enable it to align itself with the values of the Indonesian Constitution and allow religion to fulfil its responsibility towards the state and the state towards religion, without being trapped in the discourse of the politicisation of religion and the religionisation of politics. Indonesia is a multicultural country with a variety of different cultures and ethnicities. The cultural diversity that exists in Indonesia makes language as an identity of an ethnic group different. When moving to a new environment, of course, adaptation is needed, especially language adaptation to rejuvenate migrants and residents in interaction as happened in Bayur Hamlet, Balik Bukit District, West Lampung Regency. The purpose of this study itself is to analyze how the adaptation process that occurs between Javanese ethnic migrants (...) and Lampung natives also analyzes communication patterns that occur in the process of language adaptation. In this study, researchers used a qualitative type of research with a descriptive approach. The informants of this research amounted to five people who were traditional stakeholders, two ethnic residents of Lampung and two ethnic transmigrants of Java. The theory used is speech code. The results of this study show that the adaptation that occurs between Javanese ethnic transmigrants and indigenous Lampung ethnic is cultural hybridity or cultural mixing, especially in terms of language and the communication pattern that occurs in the process of language adaptation is circular. Codicology, also known as ‘the archaeology of the book’, is the study of manuscripts as physical objects. It is a discipline that studies manuscripts with a predominantly historical orientation. This essay explores the sequel to the most famous literature before and after Islamic epic story and the link between Islamic signs and literature review. The greatest pre-Islamic mysteries in the history of Moslem literature and its religious effects were disused, which were solved by manuscript studies and some case studies. The (...) research method is based on the position story and finding the Islamic signs of the research to confirm the Islamic signs in the history and its changes over time. Therefore, in this research, religious symbols in the history of literature have been studied. The authors try to reach a new knowledge regarding the foundations of this school by tracing the history of religious literature. Furthermore, the connection between culture and religious literature is made by examining the Islamic religion mysteries sample. The symbolism and explanation of codes and elements in art works have been studied and the role of myths and metaphors in semantic analysis and religious concepts has been discussed. Finally, the effect of the Islamic events in literature review and art development is discussed.Contribution: This study provides further insights into the relationship between theology and literature through a historical literature review. Robinson argues that by certain threshold criteria, pregnant women qualify for a higher moral status by reason of their pregnancies. While her intention is to make this a status upgrade for women, we worry that it may result in a status downgrade for women as a class, by presupposing and reinforcing women’s value in relation to their reproductive labour. Historically, central to feminist analysis is resistance to reductive accounts of women in relation to their reproductivity. For example, de Beauvoir addressed (...) men’s transcendence and contrasted it with women’s immanence, a status distinction possible because women are mired in expectations that they will marry, produce children and remain in the domestic realm; and for her part, Firestone argued that biological reproduction underlies women’s inferiority to men and that ‘The reproduction of the species by one sex for the benefit of both (should) be replaced by…artificial reproduction’1 2 Her concern was to liberate women from expectations of biological reproduction so their productive value in society is not reduced to their reproductive contributions. One of the goals of a certain brand of philosopher has been to give an account of language and linguistic phenomena by means of showing how sentences are to be translated into a "logically perspicuous notation" (or an "ideal language"—to use passe terminology). The usual reason given by such philosophers for this activity is that such a notational system will somehow illustrate the "logical form" of these sentences. There are many candidates for this notational system: (almost) ordinary first-order predicate logic (...) (see Quine [1960]), higher-order predicate logic (see Parsons [1968, 1970]), intensional logic (see Montague [1969, 1970a, 1970b, 1971]), and transformational grammar (see Harrnan [1971]), to mention some of the more popular ones. I do not propose to discuss the general question of the correctness of this approach to the philosophy of language, nor do I wish to adjudicate among the notational systems mentioned here. Rather, I want to focus on one problem which must be faced by all such systems—a problem that must be discussed before one decides upon a notational system and tries to demontrate that it in fact can account for all linguistic phenomena. The general problem is to determine what we shall allow as linguistic data; in this paper I shall restrict my attention to this general problem as it appears when we try to account for certain words with non-singular reference, in particular, the words that are classified by the count/ mass and sortal/non-sortal distinctions. Arthur Danto has made important contributions to both aesthetics and philosophy of history. Furthermore, as I shall try to show in this essay, his aesthetics is of great relevance to his philosophy of history, while his philosophy of history is of no less interest for his aesthetics.By focusing on the notions of representation, identity, and the identity of indiscernibles we shall discover how fruitful this cooperation of aesthetics and philosophy of history may be. Crucial to all historical writing and, hence, (...) to all philosophy of history, is the notion of identity through time and change. How could the historian write the history of x if x cannot be said to remain the same in the course of its history? It will become clear that aesthetics will provide us with a satisfactory solution for the problem, for the aestheticist notion of representation will enable us to define the notion of identity that the historian needs.Nevertheless, a certain friction can be observed between Danto's aesthetics and his philosophy of history. At the end of this essay I hope to show that Danto's philosophy of history will be our best guide to dealing adequately with this friction. (shrink)

In a discussion-note in Mind, Father P. M. Farrell, O.P., gave an account, in what he admitted to be an embarrassingly brief compass, of the Thomist doctrine concerning evil. There is one sentence in this discussion which at first glance appears paradoxical. Father Farrell has been arguing that a universe containing ‘corruptible good’ as well as incorruptible is better than one containing ‘incorruptible good’ only. He continues: ‘If, however, they are to manifest this corruptible good, they must be corruptible and (...) they must sometimes corrupt.’ The final words, despite Father Farrell's italics, strike one as expressing, not a self-evident truth, but a non sequitur. The fact that I am capable of committing murder does not entail that I will at some time commit it. It is not immediately obvious that a similar entailment holds in the case of corruption and corruptibility. (shrink)

I shall focus 0n active PAS (eg., when 21 patient takes 21 lethal drug given by E1 physician, in which case both thc physician and patient are active). I shall assume the patient is 21 competent, responsible, rational agent, who gives his being in (...) physical discomfort (pain, nausea, ctc.) as thc reason for intending his death. Objective The UK Human Papillomavirus (HPV) vaccine programme commenced in the autumn of 2008 for year 8 (age 12–13 years) schoolgirls. We examine whether the vaccine should be given when there is a difference of opinion between daughters and parents or guardians. Design Qualitative study using semi-structured interviews. Participants A sample of 25 stakeholders: 14 professionals involved in the development of the HPV vaccination programme and 11 professionals involved in its implementation. Results Overriding the parents' wishes was perceived as problematic (...) and could damage the relationship between school and parents. A number of practical problems were raised in relation to establishing whether parents were genuinely against their daughter receiving the vaccine. Although many respondents recognised that the Gillick guidelines were relevant in establishing whether a girl could provide consent herself, they still felt that there were significant problems in establishing whether girls could be assessed as Gillick competent. In some areas school nurses had been advised not to give the vaccine in the absence of parental consent. None of the respondents suggested that a girl should be vaccinated against her consent even if her parents wanted her to have the vaccine. Conclusions While the Gillick guidelines provide a legal framework to help professionals make judgements about adolescents consenting to medical treatment, in practice there appears to be variable and confused interpretation of this guidance. Improved legal structures, management procedures and professional advice are needed to support those who are assessing competence and establishing consent to vaccinate adolescents in a school setting. The quest for finding the right interpretation of Quantum Mechanics is as old as QM and still has not ended, and may never end. The question what an interpretation of QM is has hardly ever been raised explicitly, let alone answered. We raise it and answer it. Then the quest for the right interpretation can continue self-consciously, for we then know exactly what we are after. We present a list of minimal requirements that something has to meet in order to (...) qualify as an interpretation of QM. We study a propositional bimodal logic consisting of two S4 modalities £ and [a], together with the interaction axiom scheme a £ϕ → £ aϕ. In the intended semantics, the plain £ is given the McKinsey-Tarski interpretation as the interior operator of a topology, while the labelled [a] is given the standard Kripke semantics using a reflexive and transitive binary relation a. The interaction axiom expresses the property that the Ra relation is lower semi-continuous with respect to the topology. The (...) class of topological Kripke frames characterised by the logic includes all frames over Euclidean space where Ra is the positive flow relation of a differential equation. We establish the completeness of the axiomatisation with respect to the intended class of topological Kripke frames, and investigate tableau calculi for the logic, although tableau completeness and decidability are still open questions. The general context of this paper is the locality problem in quantum theory. In a recent issue of this journal, Redei (1991) offered a proof of the proposition that algebraic Lorentz-covariant quantum field theory is past stochastic Einstein local. We show that Redei's proof is either spurious or circular, and that it contains two deductive fallacies. Furthermore, we prove that the mentioned theory meets the stronger condition of stochastic Haag locality.

Narrativist philosophy of history rejects all attempts to establish an epistemological link between the past and its historical representation. Two forms of narrativism should be distinguished. The first form attacks epistemology by stressing the autonomy of historical writing with regard to the past itself ; the second form does the same by de-contextualizing the elements of the past—the very idea of the past thus becomes problematic and epistemological queries can no longer even be formulated. The first form of narrativism is (...) synthetical, suggesting that the historian should construct broad panoramical views of the past ; the second, on the contrary, aims at a dispersive dissolution of the past. The article concentrates upon the dispersive form of narrativism. It is exemplified in Ginzburg's 'micro-storie'. The implication that these 'micro-storie' should not primarily be seen as historiography in the proper sense of the word but rather as a form of narrativist philosophy of history (expressing a theory of historical representation) is accepted wholeheartedly. It is shown that the 'micro-storie' come very close to Derrida's deconstructivist reading of texts. For in both cases we have to do with 'ruptures' announcing themselves in small, seemingly insignificant details. The conclusion of the article is that the synthetical and the dispersive forms of narrativism need each other and that we can give meaning to the concept of an objective historical reality only if we accept both of them.
